General Terms and Conditions for Room Reservations, Events & Seminars
We are delighted that you have chosen the Berghotel Schatzalp. To ensure the success of your stay, we kindly ask you to observe the following terms and conditions. They govern the contractual relationship between you, dear guest / dear organiser, and the Berghotel Schatzalp AG (hereinafter referred to as BHS).
- Reservation and liability
The reservation agreement and any changes to it concerning services provided by BHS shall only become binding for the hotel once they have been confirmed or reconfirmed in writing by the hotel and the client. If the organiser (agency / contact person) is not also the organiser (guest, invoice addressee), the organiser shall be liable to BHS together with the organiser as joint and several debtors. If the booking guest registers additional guests, he/she shall be liable for the entire invoice amount resulting from the reservation. The organiser is liable for unpaid invoices of the participants (e.g. restaurant consumptions, laundry, souvenir articles, adapters etc.).
- Deadlines
Deadlines for reconfirmations are binding for both parties. After expiry of the option period, the hotel may dispose of all rooms unless a written order confirmation (mutually signed) has been received.
- Arrival & departure
Unless otherwise agreed, rooms can be occupied from 4 pm on the day of arrival. The room must be returned by 11 a.m. at the latest on the day of departure. After this time, the hotel may charge 80% of the full room rate until 6 pm, and 100% after 6 pm.
- Number of participants
For events The exact number of guests is usually not known until shortly before the event, but we ask you to inform us of the number of guests as accurately as possible at least 14 days before your event. A reduced number of guests that is not notified at least 48 hours (in the low season from April to mid-June and November to mid-December at least 72 hours) before the event can no longer be taken into account in the invoice.
- Menu / wine selection
and programme sequence The BHS must receive the final menu and wine selection at least 14 days before the event. Orders arriving later than this will only be made by arrangement. The organiser shall inform BHS of the exact programme schedule up to 48 hours before the start of the event (including special details regarding artist interludes, speeches, breaks, food intolerances, etc.). BHS can only guarantee the flawless quality of the food and drinks (e.g. coffee breaks, meals, etc.) if the participants adhere to the agreed times or if the organiser informs BHS of any changes in good time (up to 2 hours in advance).
- Corkage
A corkage fee of CHF 40.00 – 45.00 per bottle (0.75 litre) will be charged by BHS for wines, sparkling wines and other beverages (does not apply to spirits) brought by the participants themselves.
- Rooms / premises / facilities
BHS reserves the right to make rooms other than those specified available to the organiser for the holding of the event if the provision of another room is reasonable for the customer. However, BHS undertakes to inform the organiser and, if applicable, the customer of this change within a reasonable period of time. The organiser/guest shall be liable for damage of any kind or loss of equipment or inventory caused during the stay/event, without proof of fault. Damage caused by the organiser or the customer must be reported immediately to the responsible BHS management personnel currently present. The installation of decorative material or other objects is not permitted without our written consent. All decoration material must comply with fire regulations. Fog machines and naked flames such as sparklers are not permitted. Fireworks and firecrackers are prohibited by law in the entire Davos region. BHS accepts no liability for any offence. Decoration material brought by the organiser must be dismantled immediately after the event and collected again no later than 48 hours after the event. Insofar as BHS procures technical or other equipment from third parties for the customer as agreed, BHS shall act in the name and for the account of the customer. The customer shall be liable for the careful handling and proper return of the equipment and shall indemnify BHS against all third-party claims. Should faults or defects occur in technical or other equipment provided by us, we shall, as far as possible, take immediate remedial action. However, no withholding or reduction of payments can be derived from this.
- Advertising
Newspaper adverts and other advertising with reference to events at the BHS require the prior written consent of the BHS.
- Auxiliary staff
The organiser is not entitled to the provision of auxiliary personnel free of charge for the transport and assembly of decorations, technical equipment and other items provided by BHS or third parties.
- Force majeure
In the event of force majeure (e.g. fire, flooding, etc.), BHS reserves the right to withdraw from this contract
- Advance payments
The organiser accepts an advance payment invoice of up to 80% of the total arrangement, unless expressly agreed otherwise in writing. The advance payment for group and seminar reservations must be received no later than 30 days before the event.
- Invoicing
BHS invoices are payable without deduction within 20 days of the invoice date. In the event of late payment, BHS shall be entitled to initiate a reminder procedure subject to a default interest rate of 7%. A flat fee of CHF 50.00 will be charged per reminder. Invoice amounts up to CHF 1,500 are to be paid directly on site. A fee of 3% will be charged for payment by credit card. The organiser is liable to BHS for the payment of any additional food, drinks and other services ordered by the event participants.
13. Cancellation of the reservation
Cancellations will only be accepted in writing. The following costs will be charged, unless expressly agreed otherwise in writing (based on the written definitive confirmation):
Individual reservations
Low season
Up to 7 days before arrival: no costs
7 – 0 days before arrival: 100% of the booked overnight stay
High season
Up to 30 days before arrival: no costs
29 – 8 days before arrival: 75% of the booked services
7 – 0 days before arrival: 100% of the booked services
Events / group bookings from 10 to 30 persons:
Up to 60 days before arrival: no costs
59 – 31 days before arrival: 50 % of the booked services
30 – 7 days before arrival: 80 % of the reserved services
7 – 2 days before arrival: 90% of the reserved services
from 2 days before arrival: 100% of the reserved services
Events / group bookings from 31 to 120 persons:
Up to 180 days before arrival: no costs
179 – 90 days before arrival: 50 % of the reserved services
90 – 30 days before arrival: 80 % of the reserved services
30 – 2 days before arrival: 90 % of the reserved services
from 2 days before arrival: 100% of the reserved services
Events / group bookings of 121 persons or more:
Up to 240 days before arrival: no costs
239 – 180 days before arrival: 50 % of the reserved services
179 – 60 days before arrival: 80 % of the reserved services
60 – 2 days before arrival: 90 % of the reserved services
from 2 days before arrival: 100% of the reserved services
If the reserved services have not yet been specified, an amount of CHF 150.00 per person will be charged.
If the cancelled rooms can be re-let, the costs will be waived. The same rule applies to late arrivals or early departures. In the case of services provided by third parties (rental fees, catering, organisation, musicians and DJs), their terms and conditions apply – irrespective of the BHS regulations. In the event of early departure, the agreed room price and other services ordered will be charged for the remainder of your stay, unless the rooms can be re-let under the same conditions.
- Miscellaneous
The organiser / guest is responsible for insuring items brought into the hotel. The hotel cannot accept any responsibility for lost or damaged items. Parents are responsible for the supervision of children. BHS accepts no liability for accidents. Car parking spaces are available in the valley on request. We accept no responsibility for any damage to vehicles parked in BHS car parks. Prices for hall hire, rooms, food and drinks are subject to change without notice.
15. Applicable law / place of jurisdiction
These general terms and conditions and the contracts concluded on this basis are subject to Swiss law. Davos is agreed as the place of fulfilment and jurisdiction.

General Terms and Conditions of Davos Schatzalp Bahnen (hereinafter referred to as DSB), a division of Berghotel Schatzalp AG.
Subject to change without notice. The current General Terms and Conditions are published on www.schatzalp.ch.
- GENERAL
The General Terms and Conditions (GTC) apply to all services and products provided by the DSB, including ticket sales, hire of sports equipment, etc. For the products and services of the Berghotel Schatzalp and its catering establishments, as well as the botanical alpine garden, separate terms and conditions apply, which are not integrated here.
1.1 CONTRACT
The contract with the DSB is concluded when a ticket or service is ordered or purchased or utilised. These GTC shall be deemed to have been accepted without reservation with every order/purchase/utilisation.
1.2. ID REQUIREMENT
The customer must present an officially valid ID (ID, passport, driver’s license) upon request from ticket/cableway/control staff. A valid DSB ticket or TopTech Card with confirmation of purchase must also be presented.
1.3. DATA STORAGE
The TopTech Card grants access to the funicular and the corresponding facilities in the ski area for the programmed period. It can be reprogrammed with a new validity period at any time and is therefore valid for several years. The TopTech Card is available at the sales points at the valley station and at the kiosk at the mountain station for a deposit fee of CHF 5. The deposit fee will be refunded upon return of the card. (Even if the card is defective.)
Use of the TopTech Card is not mandatory if the access data can be saved on an alternative storage medium.
TopTech Tickets are free, disposable tickets for one-time use.
1.4. DATA PROTECTION
The DPO undertakes to comply with applicable data protection legislation when handling and processing all customer data and customer usage data. Customer data will only be used to maximize operational safety, in the event of misuse, or in the interest of sales promotion, product design, crime prevention, the collection of key economic data and statistics, and invoicing.
The customer hereby acknowledges and agrees that, in cases of joint provision of services in cooperation with third parties, the DPO is entitled to make customer data available to the third parties concerned to the extent necessary to provide the service. Otherwise, the disclosure of customer data to third parties is only permitted with the customer’s express consent. An exception applies only if the DPO is legally obligated to disclose personal data to third parties.
1.5. TICKETS
All tickets are personal and non-transferable.
Multi-ride tickets for the summer toboggan run are transferable and can be used by multiple people.
1.6. VALIDITY / PUBLIC TRANSPORT
1.6.1. Validity
All tickets are valid for the respective facilities and for the respective period according to the separate price list. Non-validated single tickets for the funicular are valid until the end of the current season.
Tickets for the summer toboggan run are valid for one year from the date of purchase.
1.6.2. Public Transport
Sports passes and DSB tickets are currently not valid on public transport, the RhB, or other mountain railways.
1.7. AGE GROUPS
Children up to the age of 6 travel free when accompanied by an adult. Reduced children’s fares apply up to their 12th birthday.
Reduced youth fares apply up to their 18th birthday.
Reduced senior fares apply from their 65th birthday.
Families are defined as at least one parent and one child living in the same household (confirmation of residence required).
There is no limit on the number of children, as long as they live in the same household.
1.8. CATEGORIES (FAMILIES / GROUPS)
A family is defined as at least one parent with at least one child/young person living in the same household (confirmation of residence).
A group is defined as at least 20 tickets purchased simultaneously. Associations, clubs, companies, or schools are recognized as groups. The group leader must purchase and pay for all tickets together. The DSB cannot issue group tickets individually. The tickets must either begin or end on the same day. Detailed information about attractive group discounts is available at the point of sale.
1.9. SERVICES
The services provided by DSB are based on the service description in the cable car/fare brochure or electronic media, as well as other written offers. Special fares, special requests, or ancillary agreements are only part of the contract if they have been confirmed in writing and are legally binding.
- PRICES AND PAYMENT CONDITIONS
2.1. Prices
Ticket prices are published in the current cable car fare brochure and/or online.
The prices quoted include VAT at the standard rate.
All cable car tickets are personal and non-transferable.
In the event of differing fare information in the individual brochures and electronic media, the terms and conditions set out in the current online publication (www.schatzalp.ch) apply.
2.2. Payment
Payment is due immediately upon conclusion of the contract. Ticket purchases on credit or invoice are generally not permitted. Exceptions must be agreed upon in advance and are only valid if confirmed in writing by DSB. When paying by invoice, the customer undertakes to pay the invoiced amount by the due date stated on the invoice. Objections to the invoice must be raised in writing and substantiated within 7 days. If the customer fails to meet their payment obligation within the payment deadline, they will be in default upon expiration of this period without further notice and will be charged default interest of 5%. If payment is not received after two reminders, DSB is entitled to suspend all services to the customer without further notice. DSB reserves the right to request full or partial payment in advance for services. For events with a foreign billing address, a credit card number with expiration date and the card verification number (CVC) must be provided as a guarantee, or 100% payment must be made in advance. This also applies to events booked from abroad. Any other agreements between the customer and DSB remain reserved. Bank transfer and check fees are always borne by the sender.
2.3. Currency
Prices are always quoted in Swiss francs. Euros are converted at the current daily DSB exchange rate. Change is always paid in Swiss francs.
2.4. Price and Service Changes
DSB expressly reserves the right to change service descriptions and price information on the Internet, as well as in brochures and price lists, until the contract is concluded.
- TICKETING
3.1. Refunds
3.1.1. Disruptions to Service Provision / Operational Suspensions
Operational restrictions or suspensions due to force majeure, such as wind and weather conditions, avalanche danger, strikes or official orders, or operational disruptions (e.g., due to technical defects or power outages) do not entitle the customer to a refund or compensation.
3.1.2. Pandemic
In the event of an officially mandated closure of the entire ski area/entire offering (entire area of validity) due to a pandemic, the DSB will provide the following refund for the subscriptions it has sold:
Subscription price paid / number of operating days x number of days lost
The prerequisite for a refund is that the entire area of validity of the subscription is affected by the closure. The number of days lost is based on the number of operating days. The days lost only apply if the number of operating days falls below 75%. Days lost due to the purchase date are not included in the calculation.
The refund will only be granted in the form of a credit note when purchasing the next subscription. This does not necessarily have to be the same as the purchased subscription, but must be a subscription from the selling company. Cash payment is excluded. The subscription does not need to be deposited during a pandemic and can, if possible, continue to be used until the end of the validity period after the officially mandated closure has been lifted.
3.3. Ticket Misuse
Ticket office, railway, or authorized ticket inspectors are authorized to conduct ticket checks at any time. The customer must present an officially valid ID (ID, passport, ticket). Any misuse of tickets, in particular the transfer of sports passes or the alteration of the information contained therein, will result in immediate confiscation without compensation. In addition to the standard fare for the ticket carried without authorization or an invalid ticket, a surcharge of CHF 250 will be charged based on Article 16 of the Federal Transport Act of October 4, 1985. DSB also reserves the right to prosecute. The ticket holder is responsible for ensuring that no misuse by third parties is facilitated.
- FACILITIES, SLOPES, AND BIKE TRAILS
4.1. Off-piste skiing / Wildlife and forest protection zones
Off-piste skiing, skiers, and snowboarders face increased dangers off the marked and controlled slopes. Leaving tracks on dangerous, steep slopes encourages other, inexperienced skiers to follow suit, which can lead to avalanches if weather and snow conditions change. The DSB slopes are open terrain. Small forested areas are avoided because they are protected forest and wildlife protection zones. Trees and shrubs should not be damaged, and wildlife should not be disturbed or driven from their habitats. The forest and wildlife protection zones are marked and published accordingly (www.wildruhe.gr.ch). Please note our information boards.
4.2. Reckless Behavior / Misconduct of the Ticket Purchaser
In the event of reckless behavior, violation of these regulations, or disregard of the instructions of the cable car, ticket office, or control personnel, in particular non-compliance with FIS rules, disregard of signals, instructions, and barriers, as well as when skiing on closed slopes, avalanche-prone slopes, or wildlife and forest protection zones, the DSB may revoke the ticket holder’s ticket. Outside of official operating hours, the slopes are closed, and skiing on the slopes is prohibited.
Anyone endangering safety and order in the winter sports area due to intoxication or drug abuse may be temporarily or permanently banned from using the cable car facilities and winter sports slopes. No refund of the ticket price will be given.
Anyone who damages or contaminates DSB facilities and equipment must pay the repair and cleaning costs. In the event of intentional damage/contamination, criminal charges remain reserved.
Snow sports enthusiasts who pose a significant risk to one or more other people through reckless and uncontrolled driving can be reported to the police or the public prosecutor’s office for disruption of public transport within the meaning of Article 237 of the Swiss Criminal Code. Reckless behavior includes, among other things, skiers or freeriders who disregard avalanche warning signs and lights, as well as barriers, while skiing on slopes at risk of avalanches, thereby significantly endangering the life or health of people on the slopes, downhill routes, or snow sports trails.
In contrast to the criminal sanction of punishment, the civil sanction of damages can be imposed simply by releasing the snow masses. This is the case if the party responsible for traffic safety or the commissioned piste and rescue service initiates a search for any buried persons after the snow masses have subsided, which later proves to be unnecessary. Off-piste skiers and freeriders who disregard warning signals and ride on avalanche-prone slopes and trigger avalanches violate a secondary contractual obligation and are liable to the cable car company for any damage caused.
4.3. Bike Transport / Freeride
By purchasing a bike transport ticket, the purchaser automatically accepts the MTB Code of Honor (4.7). Furthermore, the purchaser confirms that they will bear their own liability for any damage caused.
4.3.1. Freeriding
Freeriding can be dangerous. Use of the freeride slopes is at your own risk. The facility operators, landowners, and managers disclaim all liability.
4.3.2. Top-of-the-line equipment
Helmets, gloves, and a bell are mandatory. We strongly recommend a full-face helmet and protective gear. The bike should be in perfect working order.
4.3.3. Signage
Every biker/freerider must follow the signals and instructions of the cable car personnel. Vehicles and hikers have right of way at the various intersections with forest roads and hiking trails.
4.3.4. Speed
Your speed should be adapted to your ability and the difficulty of the slope. Every biker/freerider must ride within sight, and stopping must be possible at any time. In the event of a fall, immediately clear the lane.
4.3.5. Follow the rules
General mountain biking and traffic regulations also apply on the freeride slope. Failure to comply with these rules may result in exclusion from the lift facilities.
4.4. Schatzalp Piste Markings
4.5. FIS Rules
The FIS 10 Rules of Conduct apply to all snow sports guests (www.fis-ski.com):
4.5.1. Consideration for other skiers and snowboarders
Every skier and snowboarder must behave in such a way that they do not endanger or harm others.
4.5.2. Control of speed and skiing style
Every skier and snowboarder must ski within sight. They must adapt their speed and skiing style to their ability, the terrain, snow, and weather conditions, and the traffic density.
4.5.3. Lane Selection
Skiers and snowboarders approaching from behind must choose their lane so as not to endanger skiers and snowboarders in front.
4.5.4. Overtaking
Overtaking is permitted from above or below, from the right or from the left, but always at a distance that allows the overtaken skier or snowboarder sufficient space for all their movements.
4.5.5. Entering, Starting, and Riding Uphill
Every skier and snowboarder entering a run or after a stop must check both above and below to ensure that they can do so without endangering themselves or others.
4.5.6. Stopping
Every skier and snowboarder must avoid stopping unnecessarily in narrow or blind areas of a run. A skier or snowboarder who has fallen must clear such an area as quickly as possible.
4.5.7. Ascent and Descent
A skier or snowboarder ascending or descending on foot must use the edge of the run.
4.5.8. Observance of Signs
Every skier and snowboarder must observe the markings and signs.
4.5.9. Assistance
In the event of an accident, every skier and snowboarder is obligated to provide assistance.
4.5.10. Identification Requirement
Every skier and snowboarder, whether a witness or involved, whether responsible or not, must provide their personal information in the event of an accident.
4.6. MTB Code of Ethics
The 10 rules of conduct for all bikers:
- 4.6.1. Always wear gloves and a helmet.
- 4.6.2. Bikers/freeriders must ride a technically sound bike. Regular inspection of the equipment is essential.
- 4.6.3. Never overestimate your own abilities or fitness.
- 4.6.4. The road traffic regulations apply.
- 4.6.5. Respect plants and animals; only use existing roads and paths. Never ride cross-country on trails.
- 4.6.6. Bikers must not leave litter in the wild.
- 4.6.7. Bikers must be considerate of hikers and pedestrians.
- 4.6.8. Reckless descents are prohibited. If hikers approach, reduce your speed to a reasonable level.
4.6.9. Always close gates and pasture fences.
4.6.10. Instructions and signs from the police, military, and forestry personnel must be followed.
ACCIDENT IN THE WINTER SPORTS AREA
If a ticket holder has an accident in the winter sports area, the DSB emergency services can be called upon. These rescue costs will be billed directly by the DSB based on the costs incurred or included in the hospital/doctor’s bill. Third-party costs, such as ambulance transport costs, air rescue costs, etc., may also arise. It is the patient’s responsibility to assert any reimbursement claims against their insurance company.
- RENTAL EQUIPMENT
The DSB currently offers sleds for rental. The rental of sports and other equipment is governed by individual rental agreements and the terms and conditions contained therein. The General Terms and Conditions are always an integral part of such rental agreements concluded with the DSB. The renter is liable for damage to the rental equipment caused by gross negligence. In the event of theft, an official police report is required.
- ACCOMMODATION AND EVENTS
The separate terms and conditions of the Berghotel Schatzalp apply to DSB’s accommodation and event services.
- COMPLAINTS, LIABILITY
Any complaints from ticket buyers regarding DSB services must be addressed to DSB immediately. Failure to report them immediately will void any claims the ticket buyer may have against DSB.
DSB is liable for personal injury and property damage caused by it or its personnel in accordance with the following provisions. The relevant provisions of the Swiss Code of Obligations apply subsidiarily. DSB’s liability for property damage and personal injury is specifically excluded in the event of accidents resulting from failure to follow instructions, i.e.,
- Disregarding markings and information signs, leaving the secured and controlled slopes.
- Failure to follow instructions and warnings from cable car staff or the piste and rescue services.
- Failure to follow avalanche warnings.
- Negligent or intentional behavior on lifts and ski slopes.
- Participation in risky sports such as freeriding, downhill biking, paragliding, etc.
- Inadequate piste preparation.
Furthermore, DSB’s liability is primarily based on the guidelines for traffic safety for snow sports slopes. There is no liability for accidents outside of secured and marked winter sports slopes, unless DSB can be accused of grossly negligent or intentional violation of its traffic safety duty. In this case, any liability for accidents on hiking and tobogganing trails is excluded.
DSB is liable for personal injury and property damage resulting from non-fulfillment or improper fulfillment of the contract within the framework of these General Terms and Conditions and the applicable national laws. Any liability for theft in the winter sports area or for damage to property caused by third parties is excluded.
- INSURANCE
DSB recommends that all ticket buyers obtain additional insurance coverage, such as cancellation insurance, travel accident and travel health insurance, additional return travel insurance, etc.
- FINAL PROVISIONS
Communications via email are deemed to be in writing. Swiss law applies exclusively to all contracts concluded with DSB under these Terms and Conditions. The exclusive place of jurisdiction for any disputes arising from such contracts is Davos.
